By accessing or using PutHouse, Inc. ("PutHouse," "we," "us," or "our") services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our services. These Terms constitute a legally binding agreement between you and PutHouse.
You must be at least 18 years old and a resident of a jurisdiction where options trading is permitted to use our services. By using PutHouse, you represent and warrant that you meet these eligibility requirements and have the legal capacity to enter into these Terms.
PutHouse provides software tools and automation services for options trading, including strategy execution, portfolio monitoring, and educational resources. PutHouse is not a broker-dealer or financial institution, and we do not hold or custody your funds or securities.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to: (a) provide accurate, current, and complete information; (b) maintain and promptly update your account information; (c) notify us immediately of any unauthorized use of your account; and (d) accept responsibility for all activities under your account.
PutHouse integrates with third-party brokerage services through secure API connections. You are solely responsible for your brokerage account, all trading decisions, and compliance with your broker's terms. Your brokerage relationship is separate from your relationship with PutHouse. We do not guarantee the availability or accuracy of any brokerage integration.
Trading options involves substantial risk of loss and is not suitable for all investors. You may lose your entire investment and potentially more. Past performance does not guarantee future results. PutHouse provides tools for educational and informational purposes only—we do not provide investment, financial, legal, or tax advice. All trading decisions are your sole responsibility. You should consult qualified professionals before making investment decisions.
By using our automated trading features, you acknowledge and accept that: (a) automated systems may execute trades without additional confirmation; (b) technical failures may result in unintended trades or failure to execute trades; (c) market conditions may change faster than systems can respond; (d) you remain solely responsible for all trades executed through your account; and (e) you should actively monitor your positions and account.
We strive to maintain service availability but do not guarantee uninterrupted, timely, secure, or error-free access. We reserve the right to modify, suspend, or discontinue any part of our services at any time without prior notice or liability. You acknowledge that trading decisions should not rely solely on automated systems.
All content, features, and functionality of PutHouse, including but not limited to text, graphics, logos, software, algorithms, and trading strategies, are owned by PutHouse and are protected by copyright, trademark, trade secret, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written consent.
You agree not to: (a) use our services for any unlawful purpose; (b) attempt to gain unauthorized access to our systems; (c) interfere with or disrupt our services; (d) reverse engineer or decompile our software; (e) use our services to manipulate markets or engage in fraudulent activity; (f) share your account credentials; or (g) violate any applicable laws or regulations.
Our services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, error-free, or secure, or that any defects will be corrected.
To the maximum extent permitted by law, PutHouse and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, trading losses, data loss, or other intangible losses, regardless of the cause of action or whether we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless PutHouse, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of our services; (b) your violation of these Terms; (c) your trading activities; (d) your violation of any third-party rights; or (e) any content you submit through our services.
Any dispute arising out of or relating to these Terms or our services shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Delaware, and the arbitrator's decision shall be final and binding. You agree to waive your right to a jury trial and to participate in a class action lawsuit or class-wide arbitration.
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our platform and updating the "Last updated" date. Your continued use of our services after such modifications constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using our services.
We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use our services will immediately cease. Provisions that by their nature should survive termination shall survive, including intellectual property, disclaimers, limitations of liability, and indemnification.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Delaware.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy and Disclosures, constitute the entire agreement between you and PutHouse regarding your use of our services and supersede all prior agreements and understandings.
